Please carefully read our General Terms and Conditions before using our services, as they are binding on you and should be read before becoming a customer or active user of our imperialroses.hu online store.

Terms and conditions – sending flowers and gifts in Hungary – sending flowers abroad

The general terms and conditions listed here apply to all customers placing orders:

  • By placing the order, the customer acknowledges that the seller works based on the prices published on the website – imperialroses.hu – and any other source is null and void. The seller reserves the right to make changes.
  • Our florists tie unique bouquets, which are products specially made at the customer’s request, as a result, no two bouquets or boxes are exactly the same. All boxes of flowers and bouquets are of course made by hand, in which we tie and place the freshest flowers. The photographs are therefore illustrations in all cases – they indicate the nature of the bouquet and box. The boxes contain cut flowers. An ampoule filled with water is placed on the stem of each cut flower so that the flower remains fresh during transport. On the day of delivery, it is recommended to place the flowers in a vase filled with water, with the ampoules removed from the flower stem. Our boxes are made of paper, these boxes only protect the flower from damage during transport. The boxes are not waterproof. It may happen that the ampoule filled with water leaks, unfortunately we cannot check thousands of ampoules individually.
  • We can only deliver your domestic order during business hours.
  • Every day of the week, even Sundays, we deliver the orders in and around Budapest! Due to legal requirements, please place your order by Friday.
  • We can deliver the item precisely on the scheduled day. In Hungary, you have two options for delivery times: in the morning (between 9:00 and 12:00) or in the afternoon (between 12:00 and 17:00). Before beginning the delivery, our colleague will address any concerns with the customer over the provided phone number.
  • I case of funerals and wedding occasions, please contact our customer service in advance.
  • When handling shipments, our flower delivery service may enlist the assistance of a third party (such as a neighbor, receptionist, or porter) when the receiver is not at the designated address or cannot be reached. When shipments cross international borders, we must abide by the recipient nation’s customs laws and regulations.
  • Images displayed may differ from reality and in some cases are provided as illustrations.
  • Purchasing flowers – sending flowers – sending gifts are considered a matter of trust.
  • Given that the flower is a fresh product that is delivered every day, it’s probable that one of the elements of the arrangement you’ve selected is out of stock. In this instance, changing the ingredient is permitted.

Taking an Order

  • If the information provided by the buyer is incorrect or untrue, the seller cannot be held responsible for the impossible delivery.
  • The offer is always valid while supplies last.
  • In the event of a product shortage, the seller reserves the right to deliver a similar product in terms of quality, style, form, content and size.
  • Please enter the recipient’s phone number, preferably a local mobile number, to make our delivery work easier!
  • Delivery – sending flowers – sending gifts
  • In the case of a delivery to the healthcare facilities or nursing homes, please provide the room number.
  • When delivering to a hotel, camp site, or holiday village, please provide the room number and guest name.
  • Deliveries to such locations where entrance is restricted can only be guaranteed up to the front desk!
  • Delivery to a port, airport, train station, or military installation is not always guaranteed by us!
  • If, in extremely unusual circumstances, flower delivery is not possible, we will reimburse your payment.
  • If the buyer does not wish flowers for the INCREASED price, the order will be canceled and the amount paid will be refunded.
  • Reception – handing over a bouquet of flowers.
  • Since the flower is a perishable item that was manufactured especially at the request of the customer, there is no room for refunds or complaints once the product has been delivered. • In the event that the recipient rejects the shipment and it is not related to the quality of the product or service, it will be considered received!
  • In the event that the recipient and our courier agree on the delivery of the shipment at the time different than the time specified by the customer, our courier will deliver it at the time specified by the recipient. In such cases, we do not always have the means and opportunity to inform the customer of this in advance. In this case, the product is considered received!
  • When a bouquet is ordered and prepared for personal pickup, the flower shop will hold onto it for three (3) days following the order’s designated pick up date!

Due to the perishability of the product, orders paid but not collected within 3 days will be discarded and considered received!

If you entered the wrong address while placing an order or the recipient is at a different address, then a second delivery is required. That means we will invoice the customer for the price of the second or even third delivery.

Return

  • If the flower is damaged during the delivery, please return it before receiving it and we will replace it at our own expense.
  • There is no place for other compensations.

Cancelation/withdrawal rights

  • Government decree no. 17/1999. (II. 5.) is considered basis on contracts concluded between parties.
  • The Buyer may withdraw from the contract within 14 working days without reason, however, in case of cancellation of the order within 48 hours before the delivery date, we cannot guarantee the refund!
  • In all cases, cancellation must be agreed in writing with our customer service. – Considering international time zones.
  • In the case of the flower delivery service, the withdrawal period begins when the contract is concluded.
  • In the case of purchasing a perishable product, the Buyer does not have the right of withdrawal if the product has already been prepared for delivery, handed over and opened!
  • By making an order for a bouquet of flowers, you declare that the delivery (flower arrangement) will begin with your express, prior consent within 12 hours before the scheduled time of delivery, or, failing that, the scheduled working day, and you also acknowledge that you will lose your right to cancel after the service has been completed.
  • The flower is a rapidly perishable product, which was made specifically at the customer’s request, therefore there is no place for any complaints or cancellations regarding the product if the product has been received.
  • The customer with the right of withdrawal is obliged to return the product to the delivery flower shop at his own expense.
  • The buyer cannot oblige the seller to pay the return shipping fee, this is always borne by the buyer!
  • The customer will not be charged any other costs, apart from the cost of returning the product!
  • The Web shop operator has 30 days to refund the full purchase price to the customer, if the customer wishes to exercise his right of withdrawal (meaning withdrawal is approved) and has returned the ordered product.
  • In each case, the service provider should agree with the customer about the possible ways of refunding the purchase price and the shipping cost.

Pricing

  • We will invoice the product on the publicized price at the time of ordering.
  • The prices displayed for the products are in Hungarian Forints.
  • The price of the product may change due to fluctuations in the exchange rate. The displayed prices do not include extra costs and exchange rates differences charged by the customer’s bank or financial institution.
  • Indicated prices do not include the cost of delivery and handling, and the cost of the other ‘flower storage containers’ shown in the pictures (like; vase, bowl), if and as long as it is not indicated separately in the description. No separate packaging costs will be charged.
  • Imperial Roses Kft., as Service Provider, reserves the right to change the prices of products that can be ordered from the website – www.imperialroses.hu, with the amendment coming into effect at the same time as it is published on the website. The modification will not affect the purchase price of products already ordered. If, despite all the care taken by the Service Provider, an incorrect price is displayed on the Web shop interface, especially with regard to the obviously incorrect, e.g. for a price of HUF “0” or HUF “1” that is significantly different from the well-known, generally accepted or estimated price of the product, or which may appear due to a system error, then the Service Provider is not obliged to deliver the product at the wrong price. Service Provider can offer delivery at the correct price only, after receiving information on the price error, the Customer may decide not to purchase.
  • Should you inadvertently place an order or place two orders and pay for them, please get in touch with us prior to delivery, and we will reimburse the purchase price. There is an exception if the order is being shipped or has already been prepared by us or our partner.

Methods of Payment

  • online bank card payment via OTP SimplePay (also works on mobile phones);
  • cash in person at our store (1011 Budapest, Fő utca 24);
  • by bank transfer to Imperial Roses Kft’s account number 11712004-22462480 at OTP Bank;

Online bank card payment

Payments using a bank card are performed online via OTP’s SimplePay. The customer can use the OTP SimplePay interface to enter bank card details and pay for the products they have ordered online. Imperial Roses Kft will not get customer bank card information.

Data handling

It is an honor to be your extended hand, therefore we consider it of utmost importance to keep your data confidential, to whom you sent what when and what you messaged!

  • Personal data provided to Imperial Roses Kft. during the use of the Web shop will be treated as confidential and will not be disclosed to any other party, except in the case of Imperial Roses Kft.’s subcontractor or contracted partner. (e.g.: courier service, delivery partner, flower shop, marketing partner, website IT developer).
  • While browsing the Web shop, technical information is recorded for statistical purposes. (IP address, duration of visit, etc.).
  • Imperial Roses Kft. will only hand over the data to the authorities if it is legally justified and substantiated.
  • We do not accept any responsibility for the content or use of incoming (landing) pages accessible through hyperlinks pointing outward from the website.
  • We are not responsible for the content or use of any starting page pointing to us via hyperlinks.
  • Cookies must be enabled to use the service. If you do not want to allow the use of cookies, you can disable it in your browser settings. If cookies are disabled, certain elements of the service can only be used partially or not at all.
  • A cookie is a file that the server sends to the user’s browser and that is stored on the user’s computer or mobile device. No personal data is stored in the cookie.
  • Imperial Roses Kft. will keep the data recorded during the order until the Customer requests their deletion, with the exception of the data related to the order and invoicing, which must be stored by law.
  • Imperial Roses Kft. treats the data provided during subscription to the newsletter provided while browsing the web store as confidential. The option to unsubscribe is provided at the bottom of every newsletter sent, and can also be requested from one of the Customer Service contacts.
  • You can request the deletion or modification of your data at any time in writing at the e-mail address rendeles@imperialroses.hu, with the exception of data related to orders and invoicing, which are required to be stored by law.
  • In matters not regulated in these general terms and conditions, the Civil Code, Government Decree 17/1999 (II.5.) on distance contracts, and CVIII of 2001 on certain issues of electronic commercial services and services related to the information society shall govern.
  • By browsing the pages of the Web shop and placing an order, you accept the general terms and conditions of Imperial Roses Kft., as well as the principles of data management.

Content and Copyright

  • The content of the website and any component of its pages (text, image, sound, video, animation, etc.) is the intellectual creation of Imperial Roses Kft., which – unless otherwise indicated – can only be used with the prior written permission of the content provider. The second communication must comply – among other things – with the Civil Code IV of 1957, the Criminal Code IV of 1978, LXXVI of 1999 on Copyright, and Act II of 1986 on the Press, or its relevant provisions. It is prohibited to reproduce any part of the pages, in whole or in part, for online or in print publishing without the consent of the content provider.
  • The content elements of the website may not be placed in a public or closed database without prior written permission. The content and form components of the website may not be changed even in the case of publication permission, and may not be used for a purpose other than the content of the website. The copyright of the content of the website belongs to the content provider, except in cases where a different source is indicated in the specific document, or other information is provided regarding copyright. Intellectual works of third parties (articles, studies) published by the content provider may only be used in accordance with Article LXXVI of 1999 on Copyright. It is possible according to your regulations. Any use that exceeds these limits requires the consent of the respective author.
  • The content of the website is not considered a public record, a public document, or legal advice. The Content Provider considers it to be of an informational nature only. Content downloaded by following external links on the website is not under the supervision of the Content Provider.
  • In case of changes to the Terms of Use, the Content Provider will publish these changes on the website.

Legal dispute

  • The parties strive for an out-of-court settlement.
  • In the absence of an agreement, the parties stipulate the exclusive jurisdiction of the Pest District Court.
  • The Service Provider excludes any responsibility for compensation or indemnification, in the event of any indirect or direct damage or loss, which was incurred in connection with the bad faith use of the service according to these conditions, or the Customer’s careless or intentional violation of the rules, or a crime.
  • The service provider cannot be held liable or obliged to pay any compensation for damages resulting from improper use of the goods.
  • Imperial Roses Kft. reserves the right to modify the content of the website and the ÁSzF at any time, excluding provisions that are prohibited by law.

Customer service during opening hours

  • The contract concluded on the website is considered a contract concluded in writing.
  • We file the concluded contracts with a unique order identification number, which also includes the date of purchase of the service. This information is also available afterwards.
  • The contract is drawn up in Hungarian language, and the Hungarian Law is the Governing Law.

Our company strives to comply with the internet code of conduct for the content service and ethics code of the Association of Hungarian Content Providers (MTE).

You can pay for the products in the following way:

Online payments:

  • OTP Simple Pay with bank card payment (online payment);
  • By transfer to our bank account number at OTP Bank.

Not online payment

  • In our store with cash or bank card.

Money back guarantee

  • The customer must comply with the effective Civil Code. Costumer has the right to withdraw from the contract. Flowers are highly perishable commodities that require a controlled environment to stay fresh. Fresh cut flowers as any perishable item, calls for particular caution and care. The logistics involved in getting flowers from the florist to the consumer are complex and costly. Accordingly, Imperial Roses Kft. (the Seller), dealing with perishable commodities reserves the right not to reimburse the costs incurred due to cancellation. Should the buyer want to exercise their right of cancellation, they will be responsible for paying the costs associated with returning the items. The Seller has the right to seek payment for any losses brought on by incorrect usage of the products. The Buyer shall reimburse the Seller if the Products are returned under the Right of Cancellation and are not in excellent condition. For instance, the Buyer may have purposefully or negligently caused the items’ condition to deteriorate, them to be destroyed, or any other circumstance that would make a return of the goods impossible. Furthermore, the whole delivery amount is regarded as a cost after the delivery has begun.
  • The Service Provider will see to it that the goods are returned and the transaction is canceled if damage to the product is discovered upon opening in the presence of a courier. Any damage or lack of content related to the product that occurs during shipment delivery must be included in the protocol between the sender and recipient. We are not responsible for subsequent lack of content or possible damage.
  • The National Consumer Protection Authority’s website has the text of Government Decree No. 17/1999, which deals with the right of cancellation, available for download.

 

It’s also critical to note that the flower arrangements are handcrafted for each customer; they are not manufactured on a production line, so the images accurately capture the personality and setting of the boxes and bouquets.
